Na stronie internetowej Urzędu Zamówień Publicznych dostępna jest ankieta UZP, którą mogą wypełniać zamawiający i wykonawcy, wszyscy zainteresowani publicznymi przetargami. Ankieta zawiera pytania zmierzające do ustalenia pożądanych zmian w aktualnie obowiązującej ustawie.
Dokument jest skierowany do wszystkich uczestników rynku zamówień.

Ankieta UZP zawiera jedno pytanie, które przykuło moją uwagę:
Czy w Państwa opinii zasadne jest wprowadzenie obowiązku zapłaty zryczałtowanego odszkodowania za wyrządzoną przez zamawiającego szkodę wykonawcy, którego oferta nie została wybrana, w przypadku gdy sąd zmieni wyrok KIO na korzyść wykonawcy, a doszło już do zawarcia umowy o udzielenie zamówienia publicznego z innym wykonawcą?
O co tutaj chodzi?
Chodzi o sytuację, w której zostajesz bezprawnie wykluczony z przetargu i decydujesz się na skierowanie sprawy do KIO. Dopóty, dopóki Izba nie rozstrzygnie Twojej skargi, Nadleśnictwo nie może zawrzeć umowy.
Wyobraź jednak sobie, że sprawę w Izbie przegrywasz (np. zaangażowałeś słabego prawnika 🙂 i Nadleśnictwo może już powierzyć zadanie Twojej konkurencji.
Ty jednak nie poddajesz się i wyrok KIO zaskarżasz do sądu, bo takie prawo Ci przysługuje. Sąd Twoje zarzuty uwzględnia, ale usługi są już dawno w toku i Twoje zwycięstwo skutkuje raczej satysfakcją niż uzyskanym kontraktem.
Jedyne, czego możesz w tej sytuacji zażądać od Nadleśnictwa, to aby naprawiło Twoją stratę spowodowaną tym, że nie mogłeś zawrzeć umowy pomimo, iż zamówienie powinno być powierzone własnie Tobie.
Zacytowane pytanie zmierza do ustalenia, czy wysokość takiej szkody określać w formie ryczałtowej (jakaś stała kwota wynikająca z przepisów), tak abyś nie musiał jej każdorazowo udowadniać w procesie sądowym.
Moja odpowiedź brzmi: „TAK, ale…”.
Jak obliczyć odszkodowanie za błędną decyzję zamawiającego?
Ryczałtowe odszkodowanie daje możliwość uproszczonego pokrycia szkód. Wyobrażam sobie, że mogłoby zostać uzależnione od wartości zamówienia. Gdybyś wybrał taką formę rekompensaty nie musiałbyś, jak mniemam, przechodzić gehenny wieloletniego postępowania sądowego. I to jest niewątpliwy atut. W przypadku wyboru ryczałtu, prawo żądania kwot przekraczających ten ryczałt mogłoby zostać automatycznie wyłączone.
Nie chciałbym jednak, aby firmy leśne zostały całkowicie pozbawione możliwości dowodzenia przed sądem, że w ich przypadku strata była dużo większa. Może się okazać, że uszczerbek w danym przypadku jest wyższy niż stawki ustawowe i warto powalczyć o niego nawet za cenę oczekiwania w niepewności na wyrok sądowy.
