Urząd Zamówień Publicznych ma duży wpływ na interpretację ustawy. Na stronie internetowej UZP pojawiają się liczne opinie, analizy, odpowiedzi wyjaśniające wątpliwości dotyczące zasad prowadzenia przetargów. Nie raz zdarzało mi się sięgać do tych dokumentów poszukując odpowiedzi na pytania, z którymi zgłaszają się do mnie przedsiębiorcy leśni. Każdy może zajrzeć do zasobów, do czego Ciebie niniejszym zachęcam. Pisane są co prawda językiem dość hermetycznym, prawnym, ale nawet ktoś, kto nie jest prawnikiem, a od lat składa oferty, będzie w stanie dotrzeć do sedna sprawy.

Celem firmy zgłaszającej naruszenie będzie w pierwszej kolejności wszczęcie postępowania wyjaśniającego. Jestem pewien, że sam wpływ takiego pisma z UZP do Nadleśnictwa postawi pracowników zamawiającego na baczność.
Uprawnienia Prezesa Urzędu idą jednak dalej. Ma on możliwość nakładania kary na zamawiających, którzy dopuścili się wyboru najkorzystniejszej oferty z naruszeniem przepisów prawa. Taka sankcja pojawi się ewentualnie dopiero po przeprowadzeniu czynności kontrolnych.

Na koniec dwa słowa o najdalej idącej kompetencji Urzędu, którą mogą być zainteresowani najbardziej pokrzywdzeni oferenci. Otóż w skrajnych przypadkach Urząd Zamówień Publicznych może złożyć w sądzie sprawę o unieważnienie umowy zawartej przez Nadleśnictwo. Stanie się tak, jeżeli naruszenie prawa zamówień publicznych miało wpływ na wybór wykonawcy.
Gdy taki proces sądowy zakończy się sukcesem Urzędu, osoba wnioskująca o kontrolę mogłaby następnie ubiegać się od zamawiającego rekompensaty tych strat, które poniosła z powodu nielegalnego zawarcie umowy z kim innym.
Okazuje się zatem, że przy pomocy kompetencji UZP ZUL może realizować własne, indywidualne uprawnienia wynikające z prawa przetargowego. Jest to zapewne karkołomna, długotrwała droga i dotyczy nielicznych sytuacji, ale warto o niej pamiętać.
