Jeżeli zawarłeś w ubiegłym roku wieloletnią umowę z Nadleśnictwem, powinieneś sprawdzić, czy masz możliwość podwyżki wynagrodzenia.
Waloryzacja stawek w umowach wieloletnich wynika z prawa zamówień publicznych. Ustawa przewiduje w uproszczeniu dwie przyczyny zmian:
po pierwsze: wzrost minimalnego wynagrodzenia;
po drugie: wzrost wysokości składek ZUS.
Dochodzi jeszcze przypadek zmiany stawki podatku VAT, ale to w obecnym roku nie miało miejsca.
Dodatkowym warunkiem waloryzacji jest, aby zmiany opisane powyżej „wpływały na koszt wykonania zamówienia„.
Procedura podwyżki wynagrodzenia ZUL-a
Umowy zawierane z zakładami usług leśnych przewidują szczegółową procedurę podwyższania stawek.
Polega ona na tym, że jako właściciel firmy musisz złożyć udokumentowany wniosek o modyfikację honorarium. Wykazujesz w nim, że nowe składki lub płaca minimalna podwyższają koszty Twoich usługi. Nie obędzie się przy tym bez szczegółowej kalkulacji, obrazującej skalę zmian oraz ich wpływ na Twój wynik finansowy. Chodzi o to, aby przekonać Nadleśnictwo, że z uwagi na zwiększone obciążenia publiczne, dochodowość kontraktu zmniejszyła się.
Mechanizm kalkulacji mógłby wyglądać na przykład tak:
- zatrudniasz w firmie na cały rok na pełen etat pięciu pilarzy – należałoby udowodnić ten fakt chociażby kopiami stosownych deklaracji ZUS;
- pracownicy są niezbędni do wykonania całości zamówienia – w tym zakresie sugerowałbym krótkie scharakteryzowanie ich obowiązków w odniesieniu do treści umów o pracę;
- każdy z nich otrzymuje wynagrodzenie minimalne – to także powinno wynikać z treści umowy;
- w rezultacie Nadleśnictwo powinno podwyższyć Twoje stawki o kwoty odpowiadające każdomiesięcznej podwyżce pensji wszystkich pracowników.
Problem pojawi się wtedy, gdy Twoi pilarze i tak otrzymują więcej niż pensja minimalna. W takiej sytuacji trudniej dowieść, że ustawowa podwyżka ma wpływ na ich wynagrodzenie, chyba że wynikałoby to z umowy o pracę (np. ich pensja, wyższa od minimalnej, rośnie co roku o taką kwotę, o jaką rośnie pensja minimalna).
Termin na zgłoszenie wniosku
Na koniec istotna uwaga. Umowy stosowane w Lasach Państwowych przewidują termin na zgłoszenie wniosku o podwyżkę, który wynosi 30 dni od dnia wejścia w życie przepisów podwyższających elementy składowe wynagrodzenia. Obawiam się zatem, że w tym roku może już być za późno…
Pamiętaj jednak, aby w 2019 r. przypilnować upływających terminów. Postaram się przypomnieć Ci o tym z odpowiednim wyprzedzeniem.
