Proszę o informację, jak długo muszę czekać na podanie punktacji przez Nadleśnictwo
E-mail trafił do mnie po dwóch tygodniach od otwarcia ofert.
Zagadnienie sprowadza się w zasadzie do określenia terminu wyboru najkorzystniejszej z nich.
Przepisy prawa nie dają tu jednoznacznych wytycznych. W ustawie mowa jest o konieczności „bezzwłocznego” ogłoszenia, co daje Nadleśnictwu czas na podjęcie wszystkich koniecznych kroków i czynności, z zachowaniem odpowiedniej staranności.
Pamiętaj, że zanim dowiesz się czy wygrałeś, czy przegrałeś przetarg, Nadleśnictwo musi:
- sprawdzić poprawność Twojej oferty i ofert konkurencji pod kątem ich zgodności z SIWZ; na tym etapie weryfikuje się chociażby prawidłowość kalkulacji cen poszczególnych pozycji kosztorysu i ustala się, czy ewentualnie oferta tak czy owak nie podlega odrzuceniu;
- w przypadku wątpliwości – zwrócić się do Ciebie lub innego wykonawcy o wyjaśnienie oferty; na tym etapie może także dojść do usunięcia oczywistych pomyłek w ofercie – Nadleśnictwo dostrzega pomyłkę, przedstawia Ci propozycję korekty, a Ty udzielasz odpowiedzi; sam obieg dokumentacji potrwa kilka dni;
- w przypadku błędów lub nieścisłości w JEDZ – tu także dochodzi do wymiany pism pomiędzy wykonawcą a zamawiającym, a na ponowne złożenie JEDZ-a Nadleśnictwo udziela zwykle kilkudniowego terminu (o tym, jak problematyczny bywa JEDZ pisałem tutaj i tutaj);
- w końcu, przed podjęciem ostatecznej decyzji, oferta „pierwsza w rankingu” musi zostać uzupełniona o wszystkie oświadczenia i dokumenty (ZUS, KRK, referencje) – na to masz minimum 10 dni; czasami treść tych dokumentów podlega dalszym wyjaśnieniom lub wręcz uzupełnieniom, co powoduje dodatkowe oczekiwanie.
Jak widzisz, przed „przyznaniem punktacji” musi wydarzyć się dużo, aby Nadleśnictwo wiedziało, komu zakomunikować zwycięstwo w przetargu.
