Nowa ustawa przetargowa wprowadza kilka przepisów doprecyzowujących działanie konsorcjów. Jest wśród nich jeden, który budzi moje obawy.
Zamawiający ma mieć większą kontrolę nad podziałem prac konsorcjantów. Dotyczy to sytuacji, w której konsorcjum powołuje się na przerób jednego z nich. Wtedy ta firma będzie musiała wykonać usługi, do których przerób jest potrzebny. Mało tego, wraz z ofertą trzeba będzie złożyć oświadczenie odnośnie podziału prac wykonawców.
W tym miejscu właśnie pojawia się wątpliwość. Specyfikacje w Nadleśnictwach przewidywały bowiem do tej pory wymóg doświadczenia z zakresu usług leśnych o określonej kwocie. Zwykle była to suma łączna, globalna dla pozyskania, zrywki, zagospodarowania. Wyjątkowo pojawiały się przetargi o bardziej sprecyzowanych wymogach, np. obejmujących sumę przerobu tylko na partie prac, choćby pozyskanie maszynowe.
Co zatem będzie można zrobić, jeżeli specyfikacja wskaże na ogólną sumę przerobu dla wszystkich rodzajów usług leśnych i takie doświadczenie będzie miał tylko jeden z konsorcjantów?
Obawiam się, że wprowadzone reguły będą miały niewielkie znaczenie dla losów przetargu. Praktyką stanie się podpisywanie wymaganego kwitu tak, aby pasował do oferty i SWZ. Zapewne na tym się skończy. Nie wierzę, że zamawiający będą bardziej wnikliwie weryfikowali w toku przetargu zaangażowanie konkretnego podmiotu we wszystkie prace. Jeżeli będą one następnie realizowane należycie, skończy się na kolejnym „świstku” w ramach dokumentacji przetargowej. Chyba branża leśna nie jest tą, która w praktyce odczuje zmiany w omawianym zakresie…
Co innego, kiedy ewidentnym stanie się, iż firma z przerobem jest tylko figurantem i nikt jej nigdy nie widział w Nadleśnictwie. W przypadku komplikacji w trakcie realizacji zamówienia (opóźnienia, nienależyta jakość itp.) zamawiający może z tego faktu wyciągać negatywne konsekwencje. Już wkrótce przekonamy się, czy tegoroczne wzory umów przewidują z tego tytułu jakieś obostrzenia (kary umowne? rygor wypowiedzenia?).
