Zamawiający Ci tego nie zabrania, a Twoja oferta na tej podstawie nie może zostać odrzucona. Taki wymóg skądinąd naruszałby chyba zasadę proporcjonalności w zamówieniach publicznych. Wyrok KIO wydany we wspomnianej sprawie pozostaje zatem aktualny.
Prawo wykluczenia ZUL-a
Pamiętaj jednak, że zamawiający może oceniać Twoje możliwości z perspektywy zaangażowania Twojej firmy w inne przedsięwzięcia. Taka ocena wymaga jednak roztropności i wnikliwej analizy zamawiającego, któremu przysługuje w tym zakresie daleko idąca swoboda. Jeżeli zatem, pomimo jednoczesnej realizacji kilku, a nawet kilkunastu umów, Twoja oferta utrzyma się, możesz spać w miarę spokojnie, bo niezwykle trudno będzie zarzucić Lasom Państwowym działanie niezgodne z prawem.
Zaskarżanie decyzji Nadleśnictwa
Jeżeli z kolei będziesz przegranym w przetargu (czego oczywiście Ci nie życzę), a wiesz, że Twój zwycięski konkurent legitymował się tymi samymi zasobami w innych postępowaniach, radzę Ci z dużą ostrożnością podchodzić do pomysłu zaskarżenia decyzji przetargowej.
